The singer, 59, obtained an injunction to halt the sale a year ago after warning that strands left on the hairbrush could be used to extract her DNA. The items were up for sale by auction house, Gotta Have Rock and Roll but it was taken down after Madonna sought for an injunction on sale in July. I never meant to hurt you'.

The singer had previously said she did not know Ms. Lutz was in possession of the items until past year when the gossip site TMZ published the letter from Shakur.

"The fact that I have attained celebrity status as a result of success in my career does not obviate my right to maintain my privacy, including with regard to highly personal items", Madonna said in court papers.

A judge ruled that the Material Girl had directed her legal action against the wrong target in going after Darlene Lutz, a NY art dealer who helped Madonna build a collection before falling out with her.

"(Madonna) knew that throughout her relationship with Lutz, Lutz was in possession of various pieces of (Madonna's) personal property", the judge ruled.


In 2004, Madonna had also signed a release from "any and all" future claims against Lutz, meaning she could not bring this lawsuit.

"It's a clear cut victory for us", Gotta Have It! online auction house co-owner Ed Kosinski said.

Ms. Lutz said she came into possession of the items while frequently hanging around during that time in Madonna's orbit, where she "tended to be a repository for a lot of stuff where people just thought: 'Get rid of it.'" That included large piles fan mail that were often not examined at all, Ms. Lutz said.

Madonna failed to stop her longtime friend and auctioneer Darlene Lutz to stop the sale, which was stopped temporarily pending the outcome of the matter. "The starting bid for the handwritten Shakur letter is $100,000". Interest bidders can place their offers again in July when the missive hits the auction block again. "Yet before this action began, the plaintiff did not make any demand to return her possessions", reports the NY Daily News.
