Zuma appoints #StateCapture Commission of Inquiry

Public Protector Busisiwe Mkhwebane has called for a broadening of the scope of the investigation into state capture.

South Africa's president says he is appointing a commission of inquiry to look into corruption allegations that have led to calls for his ouster and weakened the ruling party.

In a statement, Mkhwebane reportedly said: "In order to ensure that no stone is left unturned in so far as the allegations of state capture are concerned, and in order to avoid any further allegations of state capture being lodged with the office of the Public Protector, the Public Protector calls upon the president of RSA to ensure that the terms of reference (ToR) for the commission of inquiry are not limited to the issues investigated or identified in the "State of Capture" report".

"I am also mindful of the concerns raised by the public protector in her report, wherein she lamented the lack of resources to conduct a wider inquiry into this matter", said Zuma.

Zuma had previously tried to get the recommendations set aside, but lost the bid in December.

"I trust that we will all respect the process and place no impediments to prevent the commission from doing its work", he said.


The commission is part of the remedial action in former Public Protector Thuli Madonsela's State of Capture report which also made damning findings against the president and high ranking cabinet ministers and placed them at the centre of a corruption ring which allegedly sought to sell the country to the controversial Gupta family.

Zuma's surprise announcement was widely interpreted to have saved him from being recalled this week. "Zuma deserves no credit for this decision".

"Pursuant to the investigation and remedial action of the Public Protector regarding complaints and allegations of the State of Capture, as well as the orders issued by the North Gauteng High Court in its judgment of 14 December 2017, I have chose to appoint a Commission of Inquiry", Zuma said in a statement.

A scandal erupted after documents leaked to the South African press previous year revealed the close ties between his family and the secretive, well-connected Gupta's, who numerous allegations revolve around.

"It is our hope that terms of reference of the Commission of Inquiry to be appointed by His Excellency President Zuma will include all the State owned entities (SoE's) without exception and will date back to pre-1994", Matuba added. Zuma lost that application but said he intends appealing.

The North Gauteng High Court ordered at the end of past year that the commission be set up within 30 days and the judge selected exclusively by Mogoeng, due to Zuma's conflict of interest.
