Rachel Witlieb Bernstein claims in her U.S. District Court for the Southern District of NY suit Bernstein v. O'Reilly, 17-cv-09483, that she was not the source of information for the April 1 story that appeared in the Times.

"He's gone far beyond that and painted our client in a bad light", lawyer Neil Mullin told WaPo, claiming that O'Reilly violated the 2002 settlement case by implying that Bernstein's claims were politically motivated, Variety reported. Unlike other claims, this one didn't involve sexual harassment. The April 1 story recounted how the anchor and network had paid $13 million in settlements over the years to her and other women who had complained that O'Reilly had abused or sexually harassed them during their employment. According to Bernstein's lawsuit, there was no hotline at the time, and she in fact told others at the network about the mistreatment. Bernstein refuted the existence of the hotline, her lawyer characterized Fox's claim as a "cynical falsehood about a nonexistent hotline" that was invented "to bolster O'Reilly's claim that the women who received settlements must have fabricated their claims or they would have complained".

"Today's lawsuit has absolutely no merit, and Mr. O'Reilly will respond aggressively in court", Newman said.

O'Reilly was sacked on April 19 from Fox News after a 20-year run at the cable network.

Bernstein's complaint also argues that O'Reilly, depicted himself as a victim, and "claimed that the complaints against him are extortionate".

Bernstein did not allege she was a victim of sexual harassment in the lawsuit. The lawsuit claims, "This is false".

"Defendants Fox and O'Reilly materially breached the Agreement by making statements other than the agreed-upon statement and by issuing false, disparaging and defamatory statements", the 14-page jury trial seeking four count complaint asserts.

Fox News severed its relationship with O'Reilly in April amid mounting harassment claims. She is now a producer for Conan, and is being represented by Smith Mullin, the same law firm that hired by former Fox News host Gretchen Carlson in her own legal battle against the network.

Rachel Witlieb Bernstein, a previous junior maker at Fox News, is one of six ladies who supposedly went into settlement assentions in the wake of claiming misuse by O'Reilly.
