Epic Games To Sue 14-Year-Old Cheater

Fortnite, which contains a a multiplayer mode heavily borrowing elements of the breakout game Playerunknown's Battlegrounds, has become a huge hit on both console and PC.

Epic Games has released a brand new patch for Fortnite which is set to add new items and fixes to Battle Royale and Save the World. This software typically makes it easier to aim guns, allowing players to automate the act of defeating opponents.

Back in October, we learned that Epic Games had filed a lawsuit against two specific Fortnite cheaters. The boy's mother claims that the company has picked his son as a "scapegoat" and she argues that a minor can not be pursued this way.

Just about every game company hates cheaters, but they are a fact of life.

She argues that Epic has no proof her son modified the game.

However, this is where it starts to get really tricky.

Based on what is said by the minor, Caleb "Sky Orbit" Rogers, in his video speaking about the lawsuit, it appears the lawsuit does not directly stem from his cheating, which he admits to in this video, but from videos he had put up previously.

Another valid argument is that by attacking the player rather than the websites that sell/provide the cheating software, Epic has ultimately made a scapegoat out of a 14 year old.

Epic had issued a DMCA takedown request for these videos, saying they amount to a guide on how to cheat, and was then promoting it on his YouTube channel. "Under these circumstances, the law requires that we file suit or drop the claim. As we said earlier, we take cheating seriously and will use all possible means to have our games remain fun and fair and supported among gamers, the spirit of competition".

Last month, Epic took the unusual step of not just banning two Fortnite players from the game for cheating, but taking them to court. She acknowledged that her son showcased those cheats during a live stream session via YouTube. Epic makes a teenager "scapegoat", because it is not able to cope with cheaters. What the company probably didn't know at the time, however, is that one of them is 14 years old, and his mother is now vigorously defending her son.

On a grander scale, the lawsuit speaks to the contentious debate around the legal enforcement of licensing agreements and terms of service contracts. We agree to these contracts without reading them or even understanding what types of behavior scale from prohibited to illegal.

The fight against people cheating in online games is getting ugly. This was a free game.
