Elliott sat out his first of six games this past Sunday against the Falcons after the Second U.S. Circuit Court of Appeals denied his request for an emergency injunction at a hearing Thursday in NY.

Roger Goodell issued the six-game suspension for domestic violence allegations levied against Elliott by a former girlfriend in July 2016.

But, quarterback Dak Prescott and the rest of the Cowboys' offense will have to figure it out over the course of the next several weeks, because Elliott has decided it's time to stop the fight. "Mr. Elliott's desire for closure in this matter is in his best interest, as well as the best interest of his teammates, family and friends".

Instead of hoping against hope that he could win his Dec. 1 hearing for a preliminary injunction and see him return before they play Dec. 10 against the New York Giants, the Cowboys know the next time they will see him at The Star will be Dec. 18 and the next time he can be on the field will be Dec. 24.

In a statement Wednesday, Elliott's side said withdrawing the appeal is in "no way an admission to any wrongdoing".


'In what may mark one of the most fundamentally unfair arbitral processes conceivable, Elliott and the Union were subjected to an arbitration process in which, among other things, there was a League-orchestrated conspiracy by senior NFL executives, including NFL Senior Vice President and Special Counsel for Investigations Lisa Friel, to hide critical information-which would completely exonerate Elliott, ' read the NFLPA's petition. Either option was thought to be a Hail Mary, and on Wednesday it was officially announced the courtroom back-and-forth was over. Roberts, who was the only person with the league to interview Tiffany Thompson, did not believe Elliott should be penalized by the league.

In eight games, he has 783 yards on 193 carries and seven rushing touchdowns.

Outside of receiving another temporary restraining order (TRO) or taking this to the United States Supreme Court, Elliott was pretty much out of options. Unfortunately for Elliott though, the court didn't schedule to another hearing until December 1, which means Elliott would have missed four games, even if he won his appeal.

Dallas will move forward with running backs Alfred Morris, Rod Smith and Darren McFadden while Elliott is suspended. The Cowboys are 5-4 and host the Philadelphia Eagles on Sunday.
