New York Bans Vaping Indoors

Gov. Andrew M. Cuomo on Monday signed legislation adding electronic cigarettes to the Clean Indoor Air Act, which bans their use everywhere that smoking tobacco products are prohibited. NY created the act in 2003, making it one of the country's first states to ban smoking tobacco products in public indoor areas.

"This measure closes another unsafe loophole in the law, creating a stronger, healthier NY for all", Cuomo said.

"These products are marketed as a healthier alternative to cigarettes but the reality is they also carry long-term risks to the health of users and those around them", Governor Cuomo said.

Specifying the absence of expansive restrictions on what chemicals e-cigarettes can entail and the amount of Nicotine they transport, the Governor's office elucidates that these elements could generate long-term unpleasant health consequences for e-cigarette users and bystanders.


One of the big concerns is the popularity of e-cigarettes among young people. The bill bans vaping at all the places regular cigarettes are already banned, like restaurants, bars and workplaces. Though the action ultimately failed, C.L.A.S.H. claimed that the regulation of e-cigarettes as an addendum to the Smoke-Free Air Act was unconstitutional. "This measure closes another risky loophole in the law, creating a stronger, healthier NY for all". Smokers say inhaling the nicotine through a vapor produced by the devices helps them quit traditional cigarettes.

It has already raised concerns that NY lawmakers are blowing smoke over the wrong products.

Nicotine delivered through vaping can still be addictive, and is often marketed with flavors such as mint chocolate, milk and cookies, and melon candy, the department said.

Singh, who indicated that he believes the new law is unnecessary, said the products he sells may be a health risk but are the lesser of two evils.
