NFL-appointed arbitrator, Harold Henderson, handed down the verdict. after hearing Elliott's case from a team led by Jeffrey Kessler - the lawyer who's repped the NFLPA on several landmark appeals including DeflateGate.
Because of the timing of Henderson's ruling, Elliott will be allowed to play in the Cowboys week one game against the New York Giants but will sit out weeks 2-7, according to multiple reports. However, it had also been reported that Elliott might be eligible to play in Week 1 if there was no decision reached by a certain time on Tuesday afternoon. Although the result of the appeal is disappointing, Elliott'sattorneys intend to give Zeke his day in federal court. In regard to new evidence presented by Elliott's counsel during the appeal, Henderson found it wasn't significant enough to warrant overturning Goodell's decision.
Elliott, the NFL's 2016 rushing leader as a rookie, was suspended after the leagueconcluded he used physical force last summer in OH against Tiffany Thompson, his girlfriend at the time. Elliott has denied wrongdoing.
If the suspension stands, Elliott would play the opener and then miss games against the Denver Broncos, Arizona Cardinals, Los Angeles Rams, Green Bay Packers, San Francisco 49ers and Washington Redskins.
McCarthy disputed a key claim in a lawsuit filed by the players' union on behalf of Elliott seeking to vacate an upcoming ruling on an appeal. The NFL Network's Tom Pelissero reported that there is no actual rule on the books that stipulates the delay of a suspension due to the passing of a Tuesday deadline, but it is a sort of standard operating procedure that the league often practices.
The NFL objected to Elliott's lawsuit by claiming that it was premature, since he filed it before the ruling was issued on Elliott's appeal. His sole focus is decide whether the process was fair. Prosecutors in OH didn't pursue the case, citing conflicting evidence. A six-game suspension is the league's standard for a first-time domestic violence offense. U.S. District Judge Amos Mazzant III is set to make his ruling by Friday evening.
The Giants won both games against the Cowboys in 2016, holding Elliott to 158 yards and a touchdown on 44 carries, just a 3.6 yards per carry average.
